These Terms of Service (the “Agreement”) are an agreement between Webron Studio (“Create”, “us”, “our”, or the “Company”) and you (“User” or “you” or “your”). This Agreement sets forth the general terms and conditions of your use of the products and services made available by Create and of the Create.com website (collectively, the “Services”). By using the Services, you agree to be bound by this Agreement. If you do not agree to abide by the terms of this Agreement, you are not authorized to use or access the Services. Webron Studio agrees to provide the services described by the website for all purchases made by the customer. The customer may add services at any time and agrees to pay for the services in advance whether this is a 1-time charge or recurring fee.

Customers agree that they are at least 18 years of age on the date of purchase. Any use of the services provided by Webron Studio, by a user under the age of 18 is a violation of this agreement and will result in termination of said agreement.

Customer agrees that they will protect, indemnify, save and hold Webron Studio harmless from any and all stipulations, liabilities, losses, expenses, and claims, as well as reasonable attorney’s fees assessed against Webron Studio, its agents, customers, officers, employees and administration that may arise or result from any service provided or performed or agreed to be performed or any product sold by its customers, agents, employees or assigns.

Acceptable Usage Policies (AUP)

Examples of unacceptable material include: IRC Bots, Proxy Scripts, Anonymizers, Pirated Software, Warez, image hosting only sites that do not host an actual domain/normal website content, Escrow, High-Yield Interest Programs(HYIP), Bank Debentures, Livechat/Chat Scripts, Download sites(Pirated Softwares), Bank Debenture Trading Programs, and Prime Banks Programs, lottery sites, muds, RPG’s, hate sites, Facebook Bots, Instagram bots (Social Networking Related Bots), hacker focused sites/DDOS Programs/archives/programs, testing environments (Storing your Website Projects), sites promoting illegal activities, Flash Games or Online Gaming Sites, Movie’s, MP3 Songs, File hosting. No refunds will be given.

We reserve the right to refuse service to anyone. Any material that in our judgment that is obscene or threatening is prohibited and will be removed from our servers with or without notice. Failure to respond to an email from our abuse department within 48 hours may result in the suspension or termination of your services. If in doubt regarding the acceptability of your site or service, please contact us and we will be happy to assist you. No refunds will be given. In case of any Website/Reseller using High Resource/Usage or which is not suitable for our Environment We have rights to cancel those orders

All the Shared Environment Plans are only for Average Usage, You need to consider Upgrading your Plans as per the Websites Usage.

You shall agree to use only licensed and legal third-party software in connection with your use of our services. Webron Studio reserves the right to suspend or cancel a customer’s access to any or all services provided, at any time, or when Webron Studio decides that the account has been inappropriately used or otherwise.

Potential harm to minors is strictly forbidden, including but not limited to child pornography or content perceived to be child pornography (Lolita). Any site found to host child pornography or linking to child pornography will be terminated immediately without notice. We will also report this to the appropriate authorities. No refunds will be given.

Every Pleak will be allocated resources according to the packages offered by Webron Studio. In a Shared environment, the sites should maintain the resource under the limit and MySQL query timing should not take long to process. If any accounts using more than the fair usage policy will be suspended and we can give single IP Address access for optimization and no Refund will be given

Uptime – The uptime of a server is defined as the reported uptime from the operating system of the server which may differ from the uptime reported by individual services. Webron Studio cannot 100% guarantee the uptime status of any server for many factors which may include but are not limited to updates to software, malicious or intentional activities, hardware failure, acts of God defined as conditions beyond our (Webron Studio and/or our vendors that provide equipment or services to us) control that interrupts services at a facility. Websites/Servers Down Due to Firewall IP Block Caused by Failed Login Attempts/Excess number of connections from Particular IP are not covered under the Uptime guarantee.

Webron Studio will not be liable for failure or delay in performing its obligations if such failure or delay is due to circumstances beyond its reasonable control, including but not limited to acts of any governmental body, war, insurrection, sabotage, embargo, fire, flood, strike or other labor disturbance, interruption of or delay in transportation, unavailability of, interruption or delay in telecommunications or third party services (including DNS propagation), failure of third party software or hardware or inability to obtain raw materials, supplies or power used in or equipment needed for the provision of the Services.

Resellers: we will suspend the site in question and will notify you so you may terminate the account. We will further monitor your activity; more than one infraction of this type may result in the immediate termination of your account. No refunds will be given.

Direct customers: Your services will be terminated with or without notice. Violations will be reported to the appropriate law enforcement agency. No refunds will be given.

It is your responsibility to ensure that scripts/programs installed under your account are secure and permissions of directories are set properly, regardless of installation method. When at all possible, set permissions on most directories to 755 or as restrictive as possible.

Unsolicited commercial e-mail/Unsolicited bulk e-mail (SPAM)

Use of our service to transmit any unsolicited commercial or unsolicited bulk e-mail is expressly prohibited. Violation of this SPAM policy will result in severe penalties.

Upon notification of an alleged violation, we will initiate a full-scale investigation during which, we may restrict customer’s access to the network to prevent further violations. If a customer is found to have violated our policy, we may, at our sole discretion, restrict, suspend or terminate the guilty hosting account. Furthermore, we reserve the right to pursue civil remedies for any costs associated with the investigation of a substantiated policy violation. We will notify law enforcement officials if the violation is believed to be a criminal offense. Anyone using our service to host websites or services that support spammers or cause any of our IP space to be listed in any of the various Spam Databases will have their account(s) immediately suspended and an administrative fee of $300.00 will be charged to your account. The account will not be unsuspected until such time that you agree to remove any and all traces of the offending material immediately upon reconnection. First violations of this policy will result in a warning and your account will be reviewed for possible immediate termination. A second violation may result in an immediate termination of your account and the administrative fees will be $600. Severe violations may result in immediate and permanent removal of the account(s) from our network without notice to the customer.

We have a zero-tolerance policy for the use of our service towards posting of messages or commercial advertisements which violate the rules, regulations, or charter of any newsgroups or mailing list. Commercial messages that are appropriate under the rules of a newsgroup or mailing list or that are solicited by the recipients are permitted.

We also prohibit hosting of publicly accessible “open relay” SMTP or anonymous remailer service for any purpose, cause, or reason whatsoever.

Shared/Reseller Hosting Policies

Shared Hosting Packages You are not allowed to use the hosting for Backup Storage, File Hosting/File Sharing/Image Hosting, You are not allowed to Store any Personal Zip files or backup of your files as a Zip in the server. The hosting should contain only the files used by the Website scripts.

The size of each mailbox should not exceed 5GB and the combined mailbox size per domain should not exceed 50GB. This is applicable for WordPress-based Shared/Reseller, and business hosting plans.

Reseller clients of Webron Studio are responsible for supporting their clients & they are responsible for their client Data’s hosted under them, Webron Studio does not offer any compensation for any type of losses that happen to them/their clients. Webron Studio does offer only limited support for Resellers Clients. If a Resellers client contacts us, we reserve the right to place the client account on hold until the Reseller can assume their responsibility for their client. All support requests must be made by the Reseller on their client’s behalf for security purposes. Resellers are also responsible for all content stored or transmitted under their reseller account and the actions of their clients. Webron Studio will hold any reseller responsible for any of their client’s actions that violate the law or Webron Studio Terms of Service / FUP Policies /. If any Reseller account is involved in doing Resource abuse or Unacceptable content abuse’s Webron Studio has the rights to block the total Reseller since the accounts should maintain under the fair usage policy. Resellers are responsible for their clients how the accounts are being hosted. Reseller Account main domain/account will be hosted under your WHM Only as your ownership so termination of the main Domain/cPanel User account will terminate all the accounts under your Reseller. On such type of termination by the Reseller, You are responsible for any type of Data/Website/Any type of losses that happen during the termination. We HostGinee does not offer any compensation for it

Shared WordPress Hosting, Reseller Hosting Customers should run their/their clients Websites As per the Policies Defined. All your sites will be hosted in Shared Environment so every Pleak you are hosted will have only limited Resource Allocated. We have the rights to suspend/terminate the Pleak/Account in question with/without Notice which is involved in Resource Abuses like CPU,RAM,MYSQL,IO,IOPS,EP

As its a Shared Environment Other Websites/Reseller’s Clients websites will also be hosted on the server so if any domains/account Violating the FUP/TOS/CPU Resources We will Suspend/Block the HTTP Access of the site in question with/without notice to stabilize the Server

Fair Usage Policy (FUP)

User may not: a) Run stand-alone, unattended server-side processes at any point in time on the server. This includes any and all daemons, such as IRCD. b) Run any type of web spider or indexer (including Google Cash / AdSpy) on shared servers. c) Run any software that interfaces with an IRC (Internet Relay Chat) network. d) Run any bit torrent application, tracker, or client. You may link to legal torrents off-site but may not host or store them on our shared servers. e) Participate in any file-sharing/peer-to-peer activities. f) Run any gaming servers such as counter-strike, half-life, battlefield1942, etc. g) Run cron entries with intervals of less than 15 minutes. h) When using PHP include functions for including a local file, include the local file rather than the URL. Instead of include(“http://yourdomain.com/include.php”) use include(“include.php”) i) Any accounts that are created without updating the nameserver or without DNS records Pointing to our servers will be removed with or without notice.

Unlimited disk space and bandwidth mean there are no set limits on our packages. Webron Studio wants you to have the resources you need to build your site without any limits. But, however, we do need to make sure we continue to provide a full active service to all our customers. As such we do require all customers to be fully compliant with our Fair Usage Policy and Terms and Conditions. Customers on unlimited hosting packages include but are not limited to shared hosting packages. As a customer of Webron Studio you agree to be subject to the following fair usage policy: The account will be primarily used for the purposes of web hosting. Unacceptable use includes, but is not limited to, large file storage and making downloads of large files such as but not limited to media files, zipped folders, and program files. File downloads are permitted, but only in the context of a functioning website. The hosting account may not cause problems with the performance of other hosting accounts hosted on the same server by making excessive demands on the resources of the server. This includes, but is not limited to, the CPU usage required to perform data processing on the account for the purposes of taking backups and other administrative tasks as well as the CPU usage required to actually serve the site on the hosting account. As a customer, you agree that Webron Studio will be determining whether an infringement of this ‘fair use policy has occurred. Wherever possible, Webron Studio will propose alternative hosting arrangements should an infringement of this policy occur. These may include but are not limited to, moving to a hosting plan with quoted disk space and bandwidth limits. If we identify an account that is not in compliance with our Fair Usage Policy or that has the potential to negatively impact the performance of our server, we will be required to temporarily suspend the account. If this happens we will work with the customer in order to resolve the issue as quickly as possible. Webron Studio hosting Solution reserves the right to revise its policies at any time without notice. Before placing an order please read our terms/privacy policy.

Uptime Guarantee

Any service interruptions or downtime due to scheduled maintenance by Webron Studio or our network providers will not count towards the uptime guarantee. Webron Studio is not liable in any way for the failure of third-party services.

HostGinee will not be liable for failure or delay in performing its obligations if such failure or delay is due to circumstances beyond its reasonable control, including but not limited to acts of any governmental body, war, insurrection, sabotage, embargo, fire, flood, strike or other labor disturbance, interruption of or delay in transportation, unavailability of, interruption or delay in telecommunications or third party services (including DNS propagation), failure of third party software or hardware or inability to obtain raw materials, supplies or power used in or equipment needed for the provision of the Services.

Backups & Security

We perform daily backups for all ours clients on Amazon S3 servers for all domains hosted on our servers via Jet-backups and those backups remain for 1-3 days, accounts should not exceed 3.5 GB of disk space, other than that if you like to make daily backups for a specific account higher than 3.5 GB please contact us to find a special offer for you.

You are responsible for any misuse of your account therefore, you must take steps to ensure that others do not gain unauthorized access to your account. In addition, you may not use your account to breach the security of another account or attempt to gain unauthorized access to another network or server.

Your password provides access to your account. It is your responsibility to keep your password secure.

Sharing your password and account access with unauthorized users is not recommended. You should take care and prevent others from using your account since you will be responsible for the consequences.

Attempting to obtain another user’s account password is strictly prohibited, and will result in termination of service.

You must adopt adequate security measures to prevent or minimize unauthorized use of your account.

You may not attempt to circumvent user authentication or security of any host, network, or account. This includes, but is not limited to, accessing data not intended for you, logging into or making use of a server or account you are not expressly authorized to access or probing the security of other networks. Use or distribution of tools designed for compromising security is prohibited. Examples of these tools include, but are not limited to, password guessing programs, cracking tools, or network probing tools.

You may not attempt to interfere with service to any user, host, or network (“denial of service attacks”). This includes, but is not limited to, “flooding” of networks, deliberate attempts to overload a service, and attempts to “crash” a host. Users who violate systems or network security may incur criminal or civil liability. Webron Studio will cooperate fully with investigations of violations of systems or network security at other sites, including cooperating with law enforcement authorities in the investigation of suspected criminal violations.

Billing & Refunds

At this time we offer Monthly, Quarterly, Semi-Annually, Annually, According to the Hosting Plans. We do offer our customers a 15 days Moneyback Guarantee So you can use the service risk-free. Our Refund Policy

We accept Paypal | Credit/Debit Cards International | Indian Cards, Netbanking, IMPS, UPI, RTGS, NEFT.

Domain Registration/Renewal/Transfer pricing can be changed as per the Registry notice and customers should pay the updated pricing to get their domain Registered/Renewed/Transfer.

For every service renewal, the due invoice will be generated before 7 days from your due date, It’s Your Responsibility to do the Payment in time to avoid any service suspension/termination. In case if your service got terminated because of your Payment issue We are not responsible for any files/contents inside your Hosting Plan. As it your whole responsibility to do the Payment in time.

Discounts

Webron Studio often offers discounts and special offers to customers. These are limited period offers and its valid for the first term only. The discounted price will not be applicable on renewals. After completing the initial term the hosting plans will automatically renew at the regular rate.

Any account found in violation of these policies will be reviewed by our sales department and the appropriate invoices will be added to the account. Coupon abuse will not be tolerated and may result in the suspension or termination of the account.

Refusal of Service

We reserve the right to refuse, cancel, or suspend service at our sole discretion. Webron Studio reserves the right to modify/change the terms of service at all times. All customers would be bound by the newest terms published on the website.

Jurisdiction

The laws of the Republic of India shall govern this agreement. In any event of a dispute, the area of Jurisdiction would be New Delhi only.

Disclaimer

Webron Studio shall not be responsible for any damages your business may suffer. Webron Studio makes no warranties of any kind, expressed or implied for the services we provide. Webron Studio disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, no deliveries, wrong delivery, and any and all service interruptions caused by Webron Studio and its employees. Webron Studio has the right to change the Terms of Service/Refund Policy/Pricing of Plans anytime with or without notice. All customers would be bound by the newest terms published on the website.
